Ok, first thing I would do is contact ACAS. Which contact details can be found on the net. i would they persue a reaction from the workplace. witholding wages is illegal, so get the contract of employment out and see what states with suspension

With that you can tell she knows she is in the wrong....


This was like the time I lived outside a post office, the door next the entrance of, the folk used to tie their dogs to the lamp post inbetween, almost every day I used to walk out only to step on some dogs piss and once I asked a lady not to tie her dogs there (I had just came out, she was just tying her dogs up) "why?"...

"Because they piss on my door step"...

She screamed" don't you swear infront of my children"..And went into a rant...

Sorry, off topic there...

Point is, she is wrong, good luck, but be prepared (And I am sure you are) the paper trail, the witnesses... GET A LAWER!

As you may well know.. that there is the whistle blowing procedures within care homes which protects your service users & YOU..
Also CSCI would also help..
To many people can be bullied in the caring profession when they try to do the right thing...
I know if the said person came into our home in a unsuitable state that put service users & staff at risk they would of been escorted off the building with the area manager being called prompto...

Good luck in standing up for what you believe is right & for trying to protect your service users....

Yes i have had the Whistleblowing telephone number since the very first tues evening, as thats the person i was going to complain to... But as you read the Dept manager asked me not too... but after the wat the manager/Owner spoke to me yesterday, im seriously thinkin about Blowing that whistle and hard!!

Then that said person maybe in the wrong job as she is putting herself before service users...maybe with the right training she would be able to cope & stay in such a profession..

I know people get scared & find it hard to stand up to people in management but its people like you & me & some of our colleagues that without our input service users would be at greater risk...

Never to late to join a union Trish..you need that extra back up to cope with the big wigs..not that you should need it as facts are facts .. but you know who you are dealing with within your care home & not us...

Ha ha ha Hula... They dont know ME.. Im not going anywhere.. I have just sent a letter off to CSCI informing them of everything... so i would love to be a fly on the wall when they get that on Monday morning and decide that my workplace needs a visit/Inspection!!!

Well i have today recieved a letter from My workplace, telling me that i have attend a Disaplinary Meeting on the 23rd oct.

I have a copy of ALL the statement including the bosses and as i thought, she has firmly denied having any Acohol in her system on the night, and not one of my (SoCalled) friends have backed me up, by refusing to make statements.. So i am fuming!

so its looking very much like i will not have a job after the 23rd!!

Do not go to that meeting alone! You are entitled to take someone along for representation. If you can get hold of someone who knows something about employment law that would help. But take someone along with you. Also don't give up, they may ask you to leave, but unless they have a cast iron case against you then it is unlikely they would win at a tribunal, and they know that. You should expect, as an absolute minimum, full pay for the period you have been suspended and, should you be sacked, one months pay for every year of service.

Im not going alone.... I have My Step Father that will be representing me, and I have ACAS on my side to help, Also CSCI too..

Im actually getting nevous now, as all the statements are for my boss, as its a family run home, of course they are not gonna go against family are they!!

I have already been paid the whole time i have been off.. co i will only get two months pay as i have been there 2 years.

I may not always agree with you but you should NOT go like a lamb to the slaughter.

Have you checked your home (buildings and contents) insurance to see if they cover paying a lawyer for you?

As a carer Trish you are certainly able to seek advice from the Transport and General workers Union, even if you are not a member they will happily answer any questions you have.

Bloody hell .. Do you know how much Lawyers cost!! LOL

The reason im taking my stepfather is coz he has many years of experience dealing with Disaplinaries. He spent 23 yrs in the army, and then became a manager having to do disaplinaries himself.. so has lots of knowledge on Employment issues/law.

co i will only get two months pay as i have been there 2 years.
As an absolute minimum! My brother lost his job as assistant manager at a pub he worked at after an incident with his manager, he received three months pay, and he had only worked there for four months. So have a little hope.

You really need a solicitor/ union rep. The fact that you are telling the truth makes no difference, as there seems to be little concrete proof one way or the other. People can and will lie.It's your word against several others, and you need to think about your reference. A paid official will bear witness to any reference agreements.

Should add that a discipinary action at work may not the same as a court case. A best fit scenario may be used rather that beyond all reasonable doubt. You should have a copy of their Disciplinary Policy. A Complaints Policy, for use of clients/relatives could also be useful, especially if they can't produce it!
See if a union will help. Otherwise think of the rest of your working life and get legal aid.

Usually youre not allowed to take a lawyer in with you.

And trish might find that most legal firms are crap. Dont even bother with them, go to the local university that has a Law Clinic, and go through them. They are much better, as they dont charge for their services. And they will take on whoever. My team are currently taking on the NHS, where all the other legal fuierms I approached didnt weant to know.

Also Unison are sh1t also.

Trish - you havent done anything wrong - do not let them brain wash you into thinking otherwise, becasue trust me, they will.

My case has been going on for almost a year now, its very hard to keep your head held high, but you have to do it.

I know i havent done anything wrong, but on THEIR statements its just all twisted and it seems like they have been very clever in turning a bad situation into something much worse.

None ofthe people i thought would make statement, have, the onlt onethat is remotely/slightly on my side is the bosses Mother.. Hmm strange eh!!

One thing i HAVE picked up on.... is i think the Boss has read my statement before she wrote hers... as i picked up something from my statement that she has commented on.. now i didnt thing this was allowed until now..

maybe someone can enlighten me on that!

i think as the boss she is allowed to read your statement,as she will probably be dealing with your disiplinary herself along with a witness i would guess.
i would ask permission for you to record the meeting so you have an accurate record of what is said.technically i can't see you losing your job as you have not done anything that equates to an instant written warning and dismissal.gross misconduct is the only avenue they can sack you on,and as you have not broken any company procedure i can't see how they can try.you were asked or told to leave the premises by the owner/manager and wether she was on duty or not would be fairly irrelevent,as being the owner she has authority at all times.if they do try and sack you,go to the industrial tribunal as you said you would.they would look at the contract of employment and disiplinary procedures at your workplace and judge wether you have broken them.you clearly have'nt,so they would usually force the employer to re-instate you and pay damages.you could then after a period of time that you choose move to another job with another employer that is not no crap.they cannot by law put anything that is untrue in your reference and by no means can they put personal opinions in.if they write you a bad reference for the sake of it and you don't get the new job because of it you can take them to court.you can also tell any future employer about you being re-instated in your job,which clearly shows your innocence.and they would not usually hold that against you.
personally i'd stick it out,keep your job or get it back,and then start to look elsewhere for another.and take great pleasure in rubbing it in.work mates who don't back you up are scum and not mates at all.employment law is there to protect and to be used by the proper authorities who know how to implement it.

Well I'd just like to take this time to.....
Thank Each and Everyone of you for your advice on this matter...

I have Sought advice from ALL angles, and Tonight is Judgement Day.... at 7pm I have my Disaplinary...
Although I laugh and Jest about it, its not at all funny coz its my future that may or may not be in Jeopardy here.

ACAS reckons they will do one of three things....

1) Sack me for Gross Misconduct, (Which is not true) so I will then file a Tribunal Case for Unfair Dismissal.
2) Slap me on the wrist for trying to Slander My Boss/Manager, and give me my job back, on the conditions i NEVER talk about it again.
3) Pay me off to keep quiet.

So i guess if you pop back at a later time I will let you all know whats happened!
