Because its not legal to serve someone drinks if they are underage.

They weren't underage. They are in love and a biracial couple.
He should be denying marriage licenses to mentally unstable couples, with history of drug abuse, child abuse, or any type of abuse that would put each other or children in harms way. But we cant make every couple take a mental health exam before marriage and copulation. We should, it would make the world a better place by avoiding those relationships to begin with. But we live in a free society, therefore they are FREE to MARRY whether he likes it or not. He needs to be suspended for being an idiot, but he had free choice to speak.

Being the grandparent to two beautiful mixed raced children I think this is disgraceful. I cant believe people still think like this. Only we can change this attitude so I for one think he should loose his licence.

I think the Justice ot the Peace is guilty of discrimination from a legal stand point, but I see no malice in his motives.

I don't live Louisiana, but he does and several other posters have concurred with his statement that the mixed offspring of interacial marriages have a very tough go of it down there. And that the marriages themselves have a lower success rate as well, probably due to race issues being heaped upon the already hard task of making a marriage work. It's all very well and nice to talk about how this ought to be and what's right and it's especially easy to hop on a soapbox and shout about racism when you yourself will not be the unhappy recipient of it.

Personally, I think the parents have an obligation to consider what kind of life sentence they are imposing on their children. As long as the whites and the blacks are still having difficulties with each other, it's irresponsible to pretend otherwise. Interacial marriage is not a form of protest and the offspring should not have to be the poster children for what's still wrong in the south (and the north to a lesser degree).

The reality is that the entire world is still struggling with race wars. This man is just taking the position that he will not participate in a process that will help put the children in the front line of that war. War is for adults, not children. If adults don't like his stance then they should work harder to improve race relations in the south.

I just read the story this morning as an AP release. It makes me embarrassed to say that I live in Louisiana. Not all of us are that ignorant.
I was appalled by the story that a public official could be so blatant in his public opinions.
I believe his constituents should petition to have him removed from his office.
The opinion that the solution is to get someone else to marry them is just common sense which apparently the couple involved should not have had to be faced with.
Not all of us southerners are racist, opinionated and ignorant but it only takes one idiot to make an entire village look bad.

Just to clarify, for a few who are missing this - I read the story (AP, by Mary Foster), and he did not refuse to marry them. It didn't get that far.

He did refuse to issue a marriage license, which merely certifies that both are legally eligible to marry one another.

Which, since they are both legally eligible to marry, is a dereliction of his duty under the law, at the very least.

Hence the ACLU's request for sanctions. Bardwell's action - or, rather, refusal to act - is illegal.

No. NO. He should not be allowed to be a justice of the peace. The operative word here being JUSTICE. He doesn't dole out justice. He doles out racism. And WTF? He allows his black friends to use his bathroom? Are you kidding me? What an incredible thing to say in 2009.

Trust me he lives it...and sees close up everyday...I'm glad he's got a sense of humor about it...

on the serious side of things it looks like it may have been a clear breaking of the law lets hope these people have the stones to get something done...does anyone know of any legal action being taken...IE may be send contributions to?

Racism, is treating people a certain way based on their skin color, or seeing people a certain way based on their skin color. So, he is a racist. That bit about "I let [black people] use my bathroom" got me shaking my head in disbelief.
He failed to see that marriages no longer last be it black/white, or black/black, white/white, etc.
His job is not to end the suffering of a child that is not even born yet. His job is to make sure the law is being implemented and respected. He failed to respect the law and thinks he is above it.
I think his motives are a little more sinister than his explanations.
Such a good hearted man who "lets" blacks use his bathroom, but won't let blackie marry white person.

Its not just a black and white issue. Its latinos and white, black and asian, white and indian. No one is of pure race anymore, we all have been interacially mixed, german-spaniards, italian-irish and others. This country is afraid because the majority soon is what was the minority. Making a controversial stance only puts this judge under the scope and the backlash will be consequential. I foresee disbarment and a class action suit.

My personal experience has always been that the worst kind of racism is that of the latent kind because it worms its way into the social fabric of a given community and becomes institutionalized to the point that people dont see it as such. There's almost no way to combat that without tearing a community apart.

Me, I'd rather someone get in my face and tell me exactly how they see me so I know precisely where I stand and because most outwardly racist people are pretty much ostracized. They are less of a threat in the day to day grind and its a threat you can clearly see.

This story speaks to that "latent" racism, that isnt quite so evident and is part of the social fabric that continues to polarize society. Having spent most of this past year in Louisiana, I can certainly attest that this does in fact exist on a grand scale. The JP is clearly a racist feeding off deep rooted attitudes that are just smoke screens for divisiveness.

I personally would never let someone do this to me and get away with it. Not by a long shot.

That's what I believe too. It doesnt seem like he can be compelled to marry people he doesn't want to. He is not abusing his power, he's opting not to use his power.

Exactly. It's what I've been saying but some people are under the impression that he can be forced to marry a couple. And I don't see how that's possible. They keep using the Supreme Court ruling but he's not saying they cannot be married. He's just not going to do it. So that's two different things.

mgs 82: Boggles the mind, it really does..... Treating people differently because of race is illegal. Pretty simple. I'd sue him. Make sure his license taken away, etc. You are referring to what a private citizen chooses to do; he is not, in his capacity as a Justice of the Peace a private citizen. Do restaurants have the right to deny service to people based on color, gender, size, shape, religion, etc.? No, because it is against the law. It may be a private business, it doesn't mean they can pick and choose who to serve.

I just want to say that as a interracial person, who is rasing an interracial child, you shouldn't assume wether people have the right to be angry about this. If you are not someone who has dealt with something like this yourself, you shouldn't have such a strong oppionion. To those who say, why get so mad?? why can't he do what he wants?It may be wrong, but he has the right. Let me tell you as someone who has experienced this attitude, I wouldn't change a thing. I got some flack from black and white people alike, even in my own family.I have felt the sting of this kind of rediculousness. Now I am the first one to say.."why does everyone have to bring race into this? or I am so oppressed, because clearly, I am not. Hell I am not even in favor of Affirmative Action, but this is one of the most horrible injustices that you can subject someone too. If some one gave me a lecture about how having a interracial child was wrong because its hard on the child, I would say..then would you tell someone with a birth defect that they shouldn't have a child? Or is you had a disfigured child, you should never bring them out because people will tease them. I am half black and was raised, the ONLY black kid, in an all white country community and I will say this. Ya, I was harrassed. People will tease children for anything, being too skinny, too fat..too light, too dark...thats the world. You should leave it up to the parents to raise those children to be strong and have the tools they need to go through everyday life. MY MOM DID! I AM WITH MY SON! If you don't see why everyone is so riled up, it's because no one has ever discrimnated against you and tried to act righteous about it. You think about how you would feel if your child came to you and said that someone wouldn't let them do something because of their race...and see the pain in their eyes, and tell me.. you would say..."he has the right to do this." I have had this kind of thing happen to me, and He should be removed from office. I have worked very hard to get to where I am and so have many others, not to have some ignorant fool with a God complex to tell me what I can do with my life, or who I can have children with. Good to see we have come so far. Public job, pulic appointed position, then performing your job or not, is not up for private selection. It comes down to this..I don't get to choose what people I will and wont deal with at work. If I don't perform my job at work, I get fired, so if he refuses to do his job, he should be fired!

^^ That is correct. As he works for the state in this capacity, he can be removed from office by the state's Supreme Court. And, given the firestorm, and the fact that his action was illegal, I think this is entirely likely to happen. If he doesn't have the sense to resign first.

^^^^ I think it's a speculation and a matter of opinion what will happen but we can get our rocks off playing God and predicting it all weekend......

Personally based on my legal experience I suspect the Supreme Court of any state will rule based on law and not public opinion.

In our state, JPs are also district court judges. I've known them to refuse to marry people for any and every reason under the sun. They may have the authority to marry folks, but that doesn't make it an obligation. However, as far as the licensing legality goes, I doubt he has any discretion on that end.

If one of those reasons is based on race or religion, it is against the law, plain and simple: national law.
