Legally I am sure a lawyer would argue, if you had sex with her while she was asleep, regardless if you had sex with her the night before etc.... but she didnt consent to it, it could be constituted as rape because she was not aware of the act itself.
However, I dont mind been awaken that way. I mean, if he is in my bed when we went asleep, whew.... I would enjoy every second of it. | |

Thats not the reason for breaking the marriage. Thats the excuse. It gets her a biggerslice of the seperation pie if she portays herself as the victim.
The kind of rape that you are talking about is the girl who passes out at the party and wakes up the next morning, in the hands or either, a total stranger, or a casual boyfreind that she's never had sex with. The kind where the girl doesn't have a chance at consenting.
This woman has consented to sex, and even demanded sex fromthis guy numerous times before.
The rape tag is being attached to so many sexual encounteres these days that it's become trivialised.
Which is why courts and cops don't go overboard when they run into one of the few genuine rape victims. | |

No woman should ever wake me up for sex... and I won't wake her either.

I happen to be a fan of the human alarm clock, giving or receiving. I think that if you are trying to wake up a partner and they aren't responding/ slowly waking up, it might get a lil' creepy. But who wants to romp someone that's comatose? Freaky in a 'guard the morgue' kinda way. I guess though that its always safer than sorry and being enlightened I will ask when it gets to that point. It is plain ignorance and stupidity to end a marriage under these circumstances. I mean you did say 'long term' and you did say THEY were married. Geez i think there was a bit more to the breakup than what you are led to believe.
Rape is a forceful act.
