This is all a subtle and concerted effort by the religious right aside from your incessant need to bring religion into everything, you made some good points. This is all about money. It costs too much to hire a lawyer for public intox, so people pay the fine and the coffers get filled -- simple economics.

It's legal because......clearing his throat.......it's legal. While we live in a democracy may I suggest you spend as much time getting politically active as you do in these forums and work for change within the political system. And if you write back and say that you can't do anything to change the laws, then I say you deserve to have pre-emptive strike on all of your freedoms. You can vote for politicians who will change the laws that these officers are carrying out, and you can vote for politicians who place our freedoms above perceived threats to our safety, whether it be drunk drivers or suicide bombers. This smacks of big brother and I personally will not visit Dallas because of this. I can see arresting people if they are out of control or doing something that is causing a public disturbance. No where in the story do they tell you what the "drunk" person was doing when arrested or if they were causing a disturbance. It's a judgment call by the police and that's what disturbs me the most. Some people get happy when they drink and some people can "hide" how much they've been drinking so it's not black and white. I don't see the TABC continuing this for very long because of the lawsuits it will bring to the state and businesses threatening to cancel conventions or events in Dallas causing the state to lose a lot of tourism dollars.
