No, I don't think is fair. Why? Because the ex had nothing to do with whatever he did to improve his income -perhaps he worked his ass off 16 hours a day, perhaps he started a business, etc.

She didn't do a thing to collaborate with him. Why should she reap the benefits of his work?

^^^^ that is why I asked for clarification on if this is spousal or child support. Both totally different in my books, your kids have every right to an increase if you get one your ex does not.

If you didn't report your income, then yes - of course....this is not money for the EX, this is money for THE CHILD - if you were both together, the child would be benefiting from the increased income, and has a right to benefit from it if you are apart.

ingraceigo, around here maint. on sposal support IS for the ex not the kids, and as I stated the ex deserves squat for changes you make later after separate, the kids however I think almost all of us agree DO deserve the increase. Sposal support continues after the kids ore no longer eligible for child support or if the move in with the other parent etc.... The custodial parent can be the one paying more to the ex in this case and in that TAKING AWAY from the children.

loonytunz, I agee spousal support is ridiculous if the ex is capable of working. That part I would agree on 100%. Child support is different, and I think as you said, we are all in agreement that kids should never go without.

The child support isn't to allow her to reap the benefits of his work. Its for the children. Even if it gets used on rent, food, gas for the car...those are all for the benefit of the children, they haveto have a place to live, food to eat and other necessities.


As for purely spousal support ? Abolish it.
