it's comments like this that make me thankful I live in a country where gun control laws are much more strict.
The punishment should fit the crime. There is a big difference between someone just stealing something from you and someone threatening your life. | |

let me try to make it simple, if u dont want to get shot then dont break into peoples houses, how is the person whos house u are breaking into supposed to know what your intentions are? if a person thought they might get shot if they break into a house it might just make them a little more hestitent, and that is called a deterent! | |

The Crown Prosecutor announced today that no charges will be laid against the victim of the home invasion near Langdon. After careful investigation, it was decided that this was a clear case of self defense. 
However, charges are still pending against the surviving (alleged) perpetrator. | |

If they ran, I might shoot them, I might not, I don't really know. I live alone, I probably wouldnt shoot someone if I interrupted a robbery. If I had a wife and kids at home, I might .........but catching some one in the act doesn't give me some knee jerk need to kill them. If I were attacked, yeah I'd shoot a gun at someone if I needed to. I am pretty good with my fists, though, a good right hand jab to the nose is usually enough to get someone's attention long enough for the cops to arrive. I dont need a gun. | |

If a person enters your home illegally and/or without consent and you feel that your life or the life of your loved ones is in imminent danger then you are JUSTIFIED if you choose to use DEADLY FORCE. We now also have the "Castle Doctrine" (a man's home is his "castle") laws in place where you are permitted to use deadly force to protect yourself, or an innocent third party from the threat of imminent death or serious bodily injury whether you are at home, in your car, place of business (provided that they don't prohibit the LAWFUL carrying of firearms) or virtually anywhere else. What is really nice about the new law is that the criminal who is/was intent on doing you harm CANNOT hold you civilly liable should you be forced to use force or deadly force on him. You are, as the VICTIM, held harmless for any civil liability that could arise from your need to use force. If an intruder comes into your home illegally then it is a pretty safe bet that he is intending to do you or your loved ones harm. You don't have to sit and wonder what his intent is, and you can dispatch him post haste. Murder? Absolutely not. To think otherwise is absolute absurdity. Is it murder when our soldiers have to go to war and kill the enemies of our country? No it isn't. When you have to kill someone in self-defense, it is NOT murder. If you came home one day to find your front door kicked-in, and then as you walk upstairs you hear blood-curdling screams, then you discover to your horror a man in your bedroom brutally raping and sodomizing your wife, daughter, or girlfriend, what would you do? A.) Stand by and watch, B.) Go call 9-1-1, & wait for the cops to get there, by which time it will be too late, C.) Turn tail and run out of the house, D.) Get your gun and kill the **stard. What would your answer be? It ought to be pretty evident. | |

A.) It may be self-defense if he's entered your home illegally and intended to do you harm, and (this is important) you were "in fear for your life." Remember that phrase.
B.) It's murder if you invited him over so you could kill him. Believe it or not, this happens.
It might also be murder if you could have subdued him by non-lethal means, or if he was attempting to retreat (it looks bad when you shoot them in the back).
Now, convince the police it's a case of A, not B. | |

Posted: 4/28/2008 8:22:18 PM | | I think here it has to do with if (and if so then with WHAT) the intruder was armed, and did he put you in immediate fear of your life (loved ones too of course). If none of this can be proved, if you drill an intruder who's armed with a lockpicking set and a ....screwdriver, or switchblade or something..... and particularly if he was down in the kitchen and you just came down and dropped him cold, it could become sticky in court. You're safer and better off locking yourselves up in a room and dialing 911. They arrive fast when you tell them there's someone uninvited in your home and you've got your family huddled up in one room. This way if THEY drop the guy, then that's on them, and you don't have to deal with all the BS that undoubtedly would go along with doing something like that --at least around this area (Chicagoland). | |

It would be much more satisfying to take a baseball bat to the intruder and beat him into a comatose state after breaking his arms and legs of course. To take his life would be wrong but having him spend his life on life support wouldn't leave you with any of the guilt brought on by causing another human being to die. | |

I am a fierce mama bear and if anyone tried, God help them cause they are goin down those stairs and whether or not they are alive at the end depends on which way they bounce I suppose after they've landed. In Canada the Criminal Code says no more force than is reasonably necessary. Sorry they are going down if they think they are gettin in here. | |
