Posted: 6/25/2008 10:34:11 AM | Despite the fact that I'm a proponent of the death penalty and would gladly throw the switch on the electric chair if given the opportunity in some cases, my resolve on the issue is still contingent on just what the crime was.
In this case, while I have no problem punishing this man severely, I don't know that his crime warrants the death penalty. Put this guy in general population and if he can still hear himself fart in two years I'd be surprised. That's what they do to guys like this in prison so really, if we want to punish this guy , is there anything more fitting than to have him experience the same violation he perpetrated upon a child ? Not to mention that he'll be experiencing it for years and years to come.
If there was some actual chance that he'd ever get out of prison (like, let's say you had the same kind of lenient punishments that are handed out to criminals in Canada on a daily basis ) then I'd say sure, make it so that the only stiffness he'll ever experience again comes with a toe tag. However, considering the Louisiana courts are now bound to feel that their authority has been undermined, I wouldn't be surprised if they gave this guy a sentance that included a decimal mark just to spite the higher courts. | |

Posted: 6/25/2008 12:07:36 PM | People like this do get back out of jail and into society, and re-offend...I work for the local child welfare office here, and I like to say - if you want to get away with murder, murder a child, preferably your own...lately the courts and punishments have become more stringent for offenders on children, for all kinds of things (thank God). A lot of child molesters don't even do jail time, because the "proof" is so hard, and the legal defenses can be so good (especially if you have the money to hire a really good lawyer).
The death penalty aside (that's another argument) I think that people who offend on children should receive greater sentences than offenders on adults - children are much more defenseless - historically it's been the opposite. | |

I am a Christian and not here to judge...but my heart says something different...! I am sure that if this happened to 1 of those judges grandkids...they would not be so forgiving! I am with the other poster...put him in the general population, let justice take it's natural course...we do not need to spend the time or money on this guy anyway...quick and easy is always the best...and then let God judge his pathetic soul...!

NOT ANYMORE!! I have worked in the prison system for 25+ years,and when I started in 1983,yes that was the case. That was a previous generation of inmates. The inmates of that era had a level that they would not tolerate... and child rape and molestation were twoe of those intolerables. Fast forward to now....and those inmates that would not tolerate the rape of a child are fewer and fewer every year due to age and the passage of time. Guess what has replaced those inmates now? Gangbangers. More and more of the young gangbangers that are the very kind of scumbag that sees NOTHING AT ALL WRONG with the rape of a woman or a child. No scruples and no conscience at all. The kind that has heard all their lives that it is OK to abuse a woman or turn a blind eye to brutality from these BS crap music videos,TV,movies,home, and other sources. They probably would not lift a finger against the guy at all. A generation of the old breed of inmates has come an gone. Fewer and fewer are incarcerated that have any societal scruples at all. As for the whole "deterrance" debate... imagine if all those convicted of raping young children (and it was confirmed through DNA) got the death penatly. You wanna bet that wouldn't be a deterrance? Hmm, have sex with an 8 year old or get put to death... if they choose the rape, then IMO, they deserve to get the needle. | |

Posted: 6/25/2008 5:19:05 PM | The death penalty prevents repeat offenses, but does little to deter the violent offender who keeps getting away with murder from doing it again. I see little point in the death penalty, but I do not oppose it on emotional grounds. Religiously I have to object to it, because I am a Christian and it does violate the mandate from Christ to "turn to him the other cheek". Of course there is a heavy degree of separation between faith and law (despite all modern/western law being deep rooted in Christian moral values; e.g. no stealing, no murder, etc.).
I think cruel and unusual punishment was the basis for the High Court's decision (correct me if I am mistaken) and I really can't see how, given that putting people to death for heinous offenses has been around for dozens of centuries, putting someone to death for child rape violates any premise of that clause. The "cruelty" with respect to the manner of execution has been almost eliminated if pain and suffering is the basis for determining cruelty. Unusual? In civilization's history death was mandated for crimes of far less severity than murder or child rape. Not too long ago cattle rustling carried a death sentence in most territories of the US (and may still be the case for many jurisdictions).
I think the SCOTUS has erred. And done so to the benefit of those who would commit horrid acts against the most vulnerable of human beings: children.

As hard as it sometimes is , I still have to stick with anti-DP. Emotionally, my instinct says "for" it w/some of these crimes, sure. But I try to override that, and make myself what is IMO better. Anyway...... everyone has an opinion on this and it's never resolved; I just think America can do better than the dubious (to say the least) company it's in with other nations that still execute criminals (Iran, Saudi Arabia, China, North Korea, Democratic Republic of the Congo....). I say, the standard solitary-type situation, as seen in the top max-security prisons; 23 hrs a day lockdown in an 8 x 10 cell, 1 hr supervised time in a solo exercise cage per day, 2 or 3 5-minute showers a week, and that's it. For life. That's no easy bid. He'll die a thousand times in there. And it's never relieved by the prospect of being peacefully put to sleep on a gurney one night either. | |

They pointed out that most of the perpetrators of child rape are family members or close friends of the family. Victims and other family members are more likely to seek prosecution if they know the perp won't be put to death. Obviously prosecution is needed for any punishment to occur. And you can count me on the side that doesn't see [merciful] death as the worst punishment. | |
