how to get child support payments lowered?

hello

I'm a single guy who always pays his child support on time and never gives much greef , until recently I was doing rather well and could afford a $650.00 child support payment .......then I lost my job (that was 10 months ago) , since that time i have been paying out of savings and now that my savings has been drying up while i seek employment (and i am seeking employment as i have travelled to other provinces for it ), I need to get my child support payment lowered to an amount that is reasonable due my now lower income.(10,000 lower)

what do i need to do?

the ex has custody and is unwilling to flex at all on any aspect , I can't afford to see or visit my son and make child support payments at the same time as he live's with her .

i send gifts , cards , talk on the phone etc...i'm a good guy just getting the shaft (or what i think is the shaft!)i'm cooperative were i give a payment a few days or weeks ahead or split a payment up etc...

Isn't it just a matter of applying to the courts? Since it has been ten months already, and it is tax time, your return should easily show the change in your circumstances ...

Hi, Contact your local child support agency....Usually there is a case worker who handles your particular case. If you explain it to him/her, they will send out a form which you complete. You can also do administrative hearing where they will investigate everything. Plan B is to hire an attroney but that will cost$$$.

The best way would be to contact them direct, fill out the paperwork, they verify it with your employer or whomever. It will be reviewed and possibly approved.....

I have been through so much, believe me. I should work for them! LOL.

With all due respects OP if you're an intelligent enough of a bloke to have a career that supports paying $650 for 1 child then what are you doing online on a FREE website asking for advice. I'm sorry if I seam rude but you wait 10 months to ask what you should do. Since I'm assuming this is a court ordered judgment then the answer now is the same as it would have been then.....go to the system that handles these judgments and file a petition for modification. I would suggest having an attorney but sometimes it's not necessary.

I waited 10 months while i was looking for work and i guess i was being generous heaven forbid .

I think i will call my lawyer to get his opinion.

You can go to the local child agency or court house and fill out the nessesary paperwork to have support lowered. If you are behind you will still be expected to make up any shortfall from before you filed.
Keep in mind that just because you are earning less does not mean your Ex can afford to keep a proper roof over your child's head with less money. Cost of raising him did not go down just your income did!

I'm one of those jack of all trades kinda guys, I cook, I build, I wrench .

I work only 6 months of the year, so I'm always intrested in meeting new friends, if you like to go quading or fishing in the back country , then your welcome to join us.

I do have a girlfriend that I met here on POF lol....yes this site actually works lol.......I met her online when I was working in High Arctic of all places.


Well for someone who also puts on his profile a profession pretending to work...your ex if she was smart would already have it copied and a sitting in her lawyers office waiting for you trying to lower your child support obligations....

So she might also argue that someone who is working in the high Arctic is very well paid and may be hiding income? Since you are sitting around for 6 months you could also be expected to find a job and earn an income to contribute to the costs in raising your child.

Just like I suggest single custodial mothers should be expected to work full time and finacially contribute to the raising of their children....why are you expecting to gety a free ride for 6 months of the year?

And your profile negates the arguement you are unable to find work,...since you suggest you are a jack of all trades kind of guy....so she will in her arguement suggest you are deliberately under-employing yourself so you can avoid cs obligations...while you play in the back country.

You better take the profile down or change it before she gets it copied.

Please remember that comment when someones income rises and you will be arguing the cs should go up! The arguement would be just because the ncp income has gone up should not require the cs to rise since the cost of raising the child would not be going up just because one parents income is higher.

oh Tealwood I wish that were the case.....that way every time one of my utility bills goes up because they keep raising the prices not because we're using more of it.....and every time the prices at the grocery store go up because of xyz factor has caused the cost of produce to go up.....and let's not even get the entire cost of gas conversation going again......every time one of these expenses goes up I should then be able to ask for an increase....yeah more $$$$....oh wait that would mean she'd actually have to make a payment for a change......how about just giving me what she owes in missed payments and well call it even......lol

LOL.....well not having ever seen a payment......but then the premise was I would be "allowed" to have custody or be the primary parent if I never asked for anything...with the threat that if i did she would then ask and probably win custodial position.

So after the 2yrs...that my lawyer told me to wait out...i figured what the heck...I didn't need her money anyways...

however with university coming up...one has other thoughts....and it seems she is struggling and complaining that I should be paying her spousal support....

I gave her a good lump sum to avoid a protracted legal battle where no one wins...but it seems her finances are getting strained and she has said something to the children....not sure what has been said since I do not ask questions ....but it was mentioned recently she is having problems and I should be paying her spousal....and since I was drinking coffee at the time.....I then had coffee on the floor which needed to be wiped up!

You go to court and file for a change of payments. I heard in CA, you will be asked to pay $100 max a month if you are unemployed.

You have children that need to be supported. The cost of raising children doesn't disappear or diminish because you lost your job. If you can afford to pay $650.00 in the past then you do seem to have some job skills.
So now, you expect the ex to come up with the difference that you are unable to pay... Look at this as a wake up call to get off your butt and find another job to support your children. This poor me attitude puts families in poverty.

You just file with the courts for a change. You can do it yourself. You may have to pay for the court but you and your ex will have to show up and you just show how much your paying and how much you make. It also goes by parenting time. If you have visitation with your children, the more you see them the less money you pay. You could try and get your visitation changed so you see them more.

90% of the people here seriously believe that i'm trying to screw over my ex .....why ? she is a good person that is doing a hard job , and doing a good job at it , i don't have any animosity towards here nor do i have any negative feelings .

I'm not an asshule or a cheapskate etc....i put money away for my son and i make sure that if they need anything i try my best to provide it for them . I take all the oppertunities i can to see him , but it is costly and i never miss a payment .
my income has changed and i don't see it returning to its former size anytime soon , dispite all my efforts to aquire a higher paying position (and yes i do make the effort), and i am more then qualified .......

$650-$560=$90 less...yes i can see how you are really getting finacially taxed in the additional payments...and how it is hurting your cash flow or savings.

I very much agree with Tealwood and Windchimez.
GOOD parents, no matter what their income level is, do what they gotta do to take care of their kids. Since you have a child and are complaining about finances i might suggest worrying about working for another 6 months out of the year, rather than playing in the country and smoking crack with your girlfriend. Since you are the NCP im sure you have more spare social time thanthe CP does anyways to go play.
Unless you're independantly wealthy bro, i get some work under the belt quick.

Just get in contact with your lawyer and he should be able to direct u from there. But keep in mind you will have to pay SOMETHING even if you don't have a job. Here, the minimal amount a person has to pay is $200/month even if they are unemployed. I guess the courts figure you can do odd jobs to get the money. You should be able to go down to your local job and family services department and they should be able to help you find a job. That's what they do here. It might not be as good a job as you had before, but sometime you just have to swallow your pride and do what you have to do to take care of your child. Or you could go back to school and use whatever is left over from your grant money each month to make payments. Even if you are not paying the full amount you were ordered to each month, as long as you pay something you won't go to jail for non-payment because they will see you are making an effort. Good luck.

Sorry sweets but here i will not agree. people make choices in life and the ones who perhaps pay the price is the child or children.

If the mother and children are living in poverty...instead of simply looking at the contributions or lack of contributions of the father why not EQUALLY look at the choices of the mother and where she is and what choices she has made in respect to her own life and being prepared to be a parent.

Your simple statement is suggesting only ncp should be held accountable for why families are living in poverty.

But i might suggest the biggest fault for why children are living in poverty is the custodial parent themself.

It is perhaps not politically correct but the reality is the custodial with or without children would probably have been in or close to the same place in life without the children.

So why give either parent a free pass?

My simple statement refers to anyone that can't get off their backside and provide for their children because there are methods of cop outs set up to get them off the hook.

The bottom lines of child support are meant to be a guideline for those that grudgingly pay for the children that they had no problem bringing into this world. A caring parent (cp or not) would make sure that their children are being cared for with a decent standard of living.

Don't believe my statement was addressed to one specific group of people.
Asssumptions based on small lines of text are not always accurate.

Well, OP, from personal experience, having checked out a lot of CS cases in the past, and having talked with lawyers, you are likely fvcked if you want to lower your payments.

Your ex can do pretty well what she wants, but you can't. In certain cases, she could even quit working and you'd have to pay the difference by paying more CS.

You've proven you can make $X so it's likely the courts will impute your income even if you are not making that much at the moment.

Suck it up, bend over, keep paying.
