I have been divorced for over 5 years and never been asked for proof. I need it now and need a letter from solicitor or the Decree Absolute. The solicitor has move practice and I can't trace her, and the document is buried in the attic. I am sure I will solve it somehow, I need it, like many parents, for student loan documentation for the UK government for child's university educations. Just interested if anyone has ever been asked to prove divorce or anything else, apart from perhaps re marriage?

OP - Look up Her Majesty's Courts and Tribunals Website and download Form D440.
Send the completed form to The Principal Registry of the Family Division & they will be able to provide a copy of your Decree Absolute.
I've never been asked to provide proof of Divorce, aside from when I got married for the second time in the early 90's, and, more by luck than good planning, I still had all the paperwork.
I threw the last lot away - but that's another story.......

to change driving licence & presumably passport you need it

Moral of the story - keep your maiden name! changing everything back was a right pain lolol

I didn't need the actual divorce papers for passport or driving licence - just the deed pole. And for my passport they wanted a statement from my bank who didn't require any documentation at all.

didnt need divorce proof for anything , because i didnt change back to my maiden name , i kept the marriage name and used Ms instead of Mrs, theres no law saying you have to change back to your maiden name after a divorce so why go through all the hassle of changing back .For yrs i have been known in my marriage name so what is the point in going through all the hassle of changing it back on everything .Its much easier to carry on using it in Ms


Perhaps because you don't want to share the same name as somebody you are no longer married to?

It's a personal choice really like anything else.

I do not want to share the same name as a man I used to be married to, I am not a widow, I am divorced.

I'm with you lady - I don't hate my ex but ive divorced him why keep his name? (actually its a distinctive name locally so thats another reason) my mum kept her married name after seperating from my dad though even though her kids were adults so is very much a choice thing

I don't see much reason to change name on marriage tbh certainly will recommend my daughter not to bother ..

I kept my ex hubbies name because it's much easier to pronounce than my maiden name lol. Was hilarious at our daughters wedding though when they got our rooms mixed up. Mr & Mrs Morgan and Ms Morgan arrived virtually together and they got the rooms mixed up. Fortunately we are all friendly so just had a good laugh about it.

I kept my married name partly because I had our son living with me...and the ex's two kids from his first marriage. I had my hands full and couldnt be harrassed with the rigmarole involved in changing everything....also it was much easier to get paperwork organised at the schools and sports clubs if I had the same surname as all the kids.

Especially with the older two.......if we had the same surname it was usually just assumed I was their mother....much easier than trying to explain why I had my ex husbands kids from his first marriage living with me.

OP, even though your solicitor has moved practice the original praxtice should have a copy of the decree absolute in storage. My ex didnt have a copy and he was able to get it from the solicitors office even though his solicitor has moved. They dug it out and gave it to him no problem.

I am separated and applied for all my kids going to uni as a single parent, which must be what you have done too. The proof I sent was my council tax with the 25 percent reduction which cites me as a single occupancy! Do you have that maybe?

Must make sure I keep mine when it comes through!!!

Although even if slightly off topic...in France it used to be (law might have changed now, I am referring to my parents divorce and that was in 1978) that if you divorce, the woman had to ask - yes ask - permission from the ex husband to keep her married name!!!
Can’t believe my mum asked my dad that, but I guess and it goes back to some of the posts...she wanted the same name as her kids .....and she kept it until 12 years ago when she remarried.......she then changed it back to her maiden name not her new husband’s!!!! :-D

yes, I have been asked for it when my kids were applying for funding for their University studies.
Sad though it may be, I am pretty organised and had it in my multi-file hehehe
Just heard today that he has dumped wife number 2....hope her filing is as good as mine :-)

hee hee that made me chuckle Lorri.. I have a good filing system too. I still have ex husband number 2's surname (after 11 years I am used to it) but I only kept it as I'd just changed my passport, driving licence and cards, etc. Couldn't be arrised to change it again. I might do at some point (my mother whitters at me to go back to my maiden name).

You can use your council tax bill showing 25% single person discount (if that still applies) or just a letter from a solicitor (any solicitor that will state it) I had to ask my ex for my decree absolute!

I've never been asked to prove anything but maybe that's because I kept it simple and never changed my name when I married.My son has my surname too , from birth.

Thanks for comments, yes it seems council tax bill is ok.
Re other note, many divorced women keep their married surnames if they are authors, publish academic papers etc, so their publications can still be traced.

I kept my married name simply because it was easier. And it's nice to have the same name as the kids really. Found it quite ironic that the Student Loan company wanted a copy of my decree absolute though given that it's 12 years old and I could have been married several times since/ live with a partner.
