I extracted the following text from a the Terms and Conditions section of a Personals website - It is NOT from POF but I feel people should be made aware of the dangers of posting without reading the small print. The site I took it from is part of a huge conglomerate which to my knowledge operates at least 1o personals sites and probably 3 times that number using the same template.

TERMS AND CONDITIONS
"By posting content to any public area of this site BECAREFUL, Inc. you automatically grant, and you represent and warrant that you have the right to grant, to BECAREFUL Inc. and its members, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display, and distribute such information, rights of publicity, and content and to prepare derivative works of, or incorporate into other works and other media, such information and content, and to grant and authorize sublicenses of the foregoing. For privacy terms, please refer to......"

Sometimes the Terms and Conditions of such sites are in tiny print and even white on white so you have to cut and paste them into your wordprocessing program then change the font colour in order to view them.

I urge you all to take precautions when signing up for anything invloving pictures and your basic personal info

Ok, explain to me in simple terms why I should be frightened. Are people using their real names on that site? Isn't the site just protecting themselves from people claiming their words or pics have been plagerized in the advert. blurbs, or by other people copying?

My understanding of this text is that you should only post if you don't mind your picture used by god knows what company to advertise god knows what product, then you should go ahead and post.

People may not be using their real names 9really stupid if they do) but many use their real pictures. By clicking on agreement to the terms and conditions you are giving the site owners permission to resell your picture to anyone or any company in the world. You are abrogating your rights to your own image, which may subsequently appear in porn advertisements or George Bush commercials. If it does you will be unable to do anything about it.

I haven't thought through all the ramifications, but appearing in a George Bush commercial would be quite frightening.

I hope my answer to the other person clarified for you too. I've been a techie for some 25 years, before Windows even. Many sites resell your image to others, or the company is sold to an even less savory company. Some of the personals sites make it impossible to remove your data and picture. I take exception to this. If my picture is going to be used for advertising, then I want to retain my rights to my picture, authorise its use, and get paid for it. As I said to the other person, I certainly don't want to appear in a George Bush commercial. Or worse. What would my kids think?)):-

Sorry but I don't have time to discuss further. I did think it of sufficient import to bring to people's attention. I'm not a lawyer but you should ask a lawyer to put the part of Terms and Conditions which I initially posted into layman's English.

My interpretation is that it's like giving a stranger the key to your front door with the full knowledge that it will NEVER be returned and you'll never know when or what it's going to be used for...

So some unscrupulous website operator can use my picture to advertise aspirin, or personal care products (I wish him luck if he tries using it to attract women, just seems to scare them off for me). (Which suits me fine, not complaining, I'm not interested in the ones too shallow to see beyond a picture.)

By posting your photos and comments on the internet you are opening yourself up to all kinds of identity theft much of which cannot be protected in a court of law anyway. Paparazzi have been using these legal loop hole for decades in exposing all kinds of personal information (true and false).

I don't see companies protecting themselves from court actions as something I should be seriously concerned with - that being said my dad always said "if you are going to be dumb, you had better be tough". Words to live (and post) by...

Will if someones going to use my picture for the "Rough Rider" Dildo company I would really like a piece of the pie but I bend over for no one, or anyone else for that matter...My identity has been ripped a few times already there some illegal alien on the other side of town using my name now, even my mother likes him better than me he cuts her lawn for free, I charge.

I agree with you poster---I have seen people's pics copied and put on other sites....pretty disturbing site also....I don't post a pic--however you won't get much mail with no pic so it depends what you are doing out here--there is a small chance from the people I have spoke to that I would meet anyone out here so it doesn't make a difference to me.

As a side comment to the fact that your picture can be used for anything the company wants, I'd like to point out that

a) this is the internet. If you don't want to risk having your pictures used and stolen, legally or not, don't post them. There are hundreds of thousands of websites that plagarize and steal and god knows what any photo they come across on the web.

b) I'd also like to point out that your pictures are most likely of poor quality, they are relatively small in size (as many personals sites limit picture size to save space), and they are probably of internet quality resolution, meaning they are 72 DPI while printing resolution is 300 DPI. So don't worry about your face being posted on a George Bush billboard, kids. :)

OP, The terms and conditions you posted are pretty standard for most websites that post that. For legal reasons it's in their best interests to include statements like that. In fact, it would be necessary for them to have that permission from you in order to be able to display your picture on someone else's screen if they view a page that has that content on it (such as your profile).

It all depends though on how you read that statement. The first regarding it is that you represent that you have the right to grant those rights to the website, and second that you actually do grant the right for them to display, so legally your content can appear on their site.

The fact that several unrelated sites might be using the exact same template could just be because the different sites could be either using the same lawyer, or the that lawyers are just using the same template text... and we wonder why lawyers charge an arm and a leg for things that even a legal assistant or law student could do.


If you really want to be confused about something, try to figure out what the term "potable" means in a legal document for intellectual property

Your kids and future employers will be able to see you doing this, if you agree to the terms and conditions below. Agreeing to these Terms and Conditions gives the owners of the site the right to manipulate your data and picture in any way they want.

Not all sites have the perpetuity clause, but it's certainly worth checking.

The reason I started this thread was because I have seen a number of people's pictures on very hard porn sites and I know for a fact that not only did they did not intend to have them displayed there. However the sites (mostly owned by 2 or 3 companies) are so misleadingly constructed that
a) these people would likely not have known what they were getting into and
b) even with serious tech smarts these people would not be able to have their pictures removed.

To me, that's a form of identity theft, if not abuse. Such sites should be boycotted.

I've heard similar stories about match, yahoo and the entire friendfinder group. Clicking a link gets a site's owner about $1.50 if you're a woman and half that if you're a man, (do the math) so they have links on even the most innocuous looking webpages

well, i hardly think it likely that any porn site would have an iota of interest in my humdrum (clothed) photos. as someone else said, anything posted on the internet could be copied and used by the copier, with hardly any effort, for whatever they like. if you post a naked photo on the web, well, you shouldn't be surprised when you end up on some porn site, and now the pic has john holmes photoshopped in, right next to you, in all his 13 inch glory.

There was an excellent article in the Victoria Times Colonist last week by a woman from NY who began a search for a partner via just such a site as POF.
The warning that really jumped out at me was "beware of men who do not post there pics."
A recent connection; innocently enough I thought and local, was just such an individual.
I was aware that he posted himself as "not single - not looking" except for perhaps an activity partner and we only had one activity in common. I did not initiate contact but he did on two separate occasions. I stopped chatting after his first contact; the second he intitated contact I decided to just chat both on POF and MSN; it was initially purely funny and platonic and gradually escalated to outright flirting - RED FLAGS - told me to beware.
When I called him on this - he became defensive as if he actually believed what he was doing was okay - NOT. What if he approaches a truly vulnerable lady who, although is aware of his NOT SINGLE status takes his flirting seriously and if his flirting becomes more open becomes emotionally involved - OR what if he becomes emotionally involved - inadvertently - HE MUST NOT SEE HOW HIS ACTIONS COULD SERIOUSLY HURT GOOD PEOPLE - or even jeopardize himself or others as well.
If he is not single, okay - but he is a player - and he should go and be 'NOT SINGLE' with whoever he is 'NOT SINGLE' with. Another fellow (and there are others) - again without pics- who are much more blatant about what they are looking for - ewwwww. Of course to each his own - they get no response from this lady.
I do get pop-up from porn sites and wonder if some of these guys first above mentioned are also haunting them and God forbid they should use their expertise (one of the above works with computers) to post someone's pic. All we can hope for is that these players answering their doors to the RCMP - LETS HOPE.
