Regardless my personal opinion of what is known in Canada as "in loco parentis" or in the US as the "estoppel doctrine", what it hits me like a train, is that in both countries is invoked "in the best interest of the child".

Yet, as result of this policy, the ironic situation arise when a father is set to pay less for his own children because money is already diverted for obligation to non-biological others.

It was done and since it was already determined is a matter of compliance with the law and not about personal opinions.
As a public official, he must provide the services set on his duties according to the law.
As judicial officer, he must exercise his obligations by the oath he took to uphold the law.
As state's representative, by the power invested and the authority granted, he's obligated to act as public servant rather than a private citizen.
If we are willing to accept the idea that "the law is reason, free from passion" then, we must accept the idea that is not about what we think o want but, about what can be proved.
Futhermore, under the same premise, we must accept that the law is not about moral, fairness, right or wrong but, about what is legislated.
If we are able to understand that the law is a reflective tool for the organizational structure and functioning of the societal evolution, then we must obey the change in legislations as the logical consequence of the time we live, regardless that our personal opinion can remain in the past.

Anti-miscegenation laws were edicts to made unlawfull interracial relationships.
Politically, it helped to expand slavery as a system and to perpetuate the idea of white supremacy.
Economically, it prevented the bi-racial offspring from obtaining free status and to remain slaves because the nature of the illicit intercourse.
Socially, it added greater power to control white women choices by penalizing under adultery/fornication provisions their possible preference for negroes as husbands and paramours.
Even after the Civil War, when state leaders worked to adjust some of the law to accommodate "emmancipation", new provisions -like the Acts of Arkansas of 1866- had a clause to declare that authorizing negroes to marry doesn't imply the right to cross the color line.
It's not a relevant coincidence that the phrase "separate but equal" -derived from a Louisiana law in 1890- as a doctrine to perpetuate racial segregation still is to be argued from the same State's Judge to prevent what it was deemed as legal more than a century ago but, unconstitutional more than 4o yrs ago.
It's relevant that while -as a persona- mentality can't be legislated, it's the law the only recourse for the deterrent of the actions.

In the case of Loving v. Virgnia, 1967, it was ruled to lift all exclusions and limitations on interracial marriages.
This issue has been dealt before, according to the law, regardless personal opinions.
From the Office of Attorney General, State of Texas, Opinion No. JM-1, March 8, 1983.- The Attorney General concluded that "there can be no doubt that when a Justice of the Peace performs a marriage ceremony, he is acting in the name and under the authority of the State of Texas. And he is thereby enganging in 'state actions'."
Since the Justice of the Peaces are state officials on state actions he will be in violation of the constitutional guarantee of the equal protection clause if refuses to comply with his duties on racial grounds.
More recently, as result of the ruling in the case of Kerrigan v. Commission of Public Health, 2008, based also on the equal protection clause lifting the ban on same-sex marriage...
In Connecticut, in the Bill No. 899 for disccusion of legislation to implement equal treatment to homosexual couples it was stablished on Section Seven "to ensure that clergyman and Justice of the Peace may choose not to solemnize certain marriages consistents with the rights under the free exercise of others provisions of the State and Federal Constituions."
However, as Oct 28, 2008, the Attorney General Office stated that "public official who has been authorized to perform marriages may not refuse to perform marriage for discriminatory reasons in violation of the Connecticut Constitution."
I don't know how the contradiction of the proposed Bill and the DA's Memo was solved.
I do know that the State of Massachussets did not granted Justice of the Peace exclusion from performing same-sex marriage under religious beliefs protection.
They were deemed as State officials on secular services governed by the principle of separation of the State from the Church and they must choose between to follow the law of the land or the law of their god.

Not getting into the conditions for membership to be part of the Justice of the Peace Associations at the State and Federal level, nor discussing the code of ethic for which all of them are bonded, nor the oath for compliance and respect to the letter of the law... all States and Federal laws have provisions on the law preventing discrimination based of race.
If racial segregation or discrimination is not a dead letter of the law, these Louisina's Justice of the Peace is not honoring the law he sworn to represent.

Here is another principle: "the law is reason, free from passion".
It's not about what we believe/think/wish/want, it's about what can be proved.
It's not about moral/fairness as right/wrong, it's about what is legislated.

This is not about John Doe or Joe the Plumber who can say and do wathever they want, not being representatives of the judicial system.
This is a Judge, who represents the State, in its judicial branch and who's job is to apply the letter of the law under the idea that Justitia, is blind.
This situation is about the law, it can't be about what the JP thinks or believes.
He may be a racist, since his thoughts can't be legislated.
Futhermore, under the right to free speech without the political correctness, he can spit all his venom.
Yet, as judicial officer -preciselly on functions for the application of the law- he must comply with his duties according to legislation and can't be above its letter.
Duties that are part of his job, according to Federal and States laws, to be performed without distinction of origin, credo, color of the skin...
Not to be applied as a selective option, nor conditional to his personal opinion but, governed for the sworn affidavit of compliance for application and the oath he took to defend and uphold the same law and the same principles that now he's pissing on... just because he doesn't like interracial marriage.
Technically, there is a violation of the law of the land: the different, but equal doctrine to justify segregation.
By the power invested and the authority granted for social recognition he was asked to issue a license's marriage. Not an audit for income tax purposes, nor to fix a car, nor to fly a plane, nor to change a transformer in an electrical sub-station.

More power and authority than a JP had a President... and he resigned, before to be impeached by Congress or to be removed from Office.

Contrary to the "feminism" guidelines for a man/woman interaction -where everything have to be about confrontation and competition- the idea of equality has become such obssesion to perpetuate antagonism... that we are more focused on what set us appart than on what bring us together.
Men and women are physical, physiological and psychological differents. That's all.
None is better than the other and whatever skill or ability has anyone of them that excels the other in that specific field, is just to be seen as the capability to do better for the common welfare.

After all, the day we don't think that one hand washes the other and both, the face... we'll stay as dirty as the day before.

The scope of work from a JP, among several other things, is to perform State's sanctioned marriage.

As a basic principle for application, the law is not to tell anyone about what to do but, what can't be done.
As long the interested parties comply with the provisions of the Family Law regarding the requirements for marriage in the State of Louisina, they can get married.
As long a JP has no legal reason -much less personal- to deny services which fall under his jurisdiction/power/authority, is obligated to perform his job.

Btw, in the State of Massachussetts, a Justice of the Peace may be abolished, transferred, and/or penalized if refuses to perform same-sex marriage.
Yet, it's not the same in Connecticut where other considerations apply by legislation.

A Justice of the Peace is a Government's representative, an official from the State, either appointed by a judiciary commission or elected by citizen's vote, whom salary is paid by the taxpayer's money and which services doesn't fall into the private practice with the liberty to refuse or to choice his clients.
He is obligated by the authority which represents to uphold the law and is abusing the power invested for denying service to local residentes under his jurisdiction.
As far as 1963, US Supreme Court ruled that the government cant' tell the people who can or can not marry to and the Family Law of the State of Louisiana has no provision or limitations regarding race for a civil marriage.
(if any provision and/or limitation for interracial marriage, it would be also unconstitutional since federal laws do not condone segregation/discrimination.)

According to the ACLU of LA a letter was sent to the state's judiciary committe requesting to open an investigation over the allegations.
According to the NY Daily News the couple will look into failing a complaint for discrimination against the US Department of Justice.

Secondary insurance is a complement for the primary one, not to replace it.
Again, once you get the policy's papers read about the inclusions, exclusions and limitations of coverage.
All the extras, who is not well documented as medically necessary and/or reasonable priced, will be an out of pocket expensives.

Your coverage under the State, as insured, doesn't change. You're not included in the court order.
The coverage of the child under the State ends once the private insurance takes over.
If you don't want to wait for the father initiative, you may do it yourself with the court order and the child's birth's certificate.

Once the enrollment of your son is effective -under the private insurance from the father- the health care administration should mail two set of the policy's coverage with all the inclusions, exclusions and limitations, the breakdown of co-payments services and the list of listed clinics and physicians under contract, along with the ID cards. One, for the father as the insurance provider and other, to you as the custodial parent.
Regardless, before any treatment takes place be sure about previous approval. Otherwise, will be you or the father who will pay the difference.

Arrangement as to where should the child be taken for medical care should be discussed once you're familiar with the list of providers.
A clinic or doctor who is not in the list of contractual providers will increase the cost -which limit the yearly cap and/or increase the co-payment for services.
That consideration should be kept in mind for the medical attention, as well as the vision and dental provisions.
In case a change from clinic o doctor's office have to be made in order to reduce the cost associated with the attention, you can request a copy of the medical history for the records in the new facility or physician.

I'm sceptic to see this as a sign of change from policy in Family Court. I see it as a manipulation of a political moment.

In the State of Georgia, as last month, a man was released from prison after spending more than a year behind bars for non payment of CS.
He was previously employed, lost his job, become indigent yet, liable for payments regardless the fact that -twice in nine yrs- DNA test showed he wasn't the biological father of the child, nor ever lived in the same house with the woman.

In the State of Ohio, where the jailed woman is from, it is been considered outrageous for a while, the situation when in this time of economical recession and lack of job oppportunities millions of men entitled to unemployment compensation are denied of those benefits.
Those unemployed men have their check withheld and deprived to support themselves because are readdressed toward CS payments to mothers who are actually working.
Millions of payors, are not the biological fathers of the children they support and are, at the same time, uncapable to support their own.



Edit below: Paternity fraud is legally accepted under what is known as the estoppel doctrine for US and/or loco parentis for Canada.
As July, 2009, the unemployment rate was set on 9.4%. Do you really believe there are 14.5 Americans who don't want to work or can make a living flipping burgers?

The law is not to tell you what to do but, what can't be done.
You may pay for ALL college and living expensives of your daughter. It's your choice.
However, child support is to be paid to the custodial parent. It's not a choice.
If the amount of CS is set in 300 per month and -as a payor- you give 1000 daily, directly, to your daughter... it's irrelevant.
Still, you owe the amount for child support, can fall in arreas and be deemed as deadbeat dad.

I agree with prevention of teen pregnancy, I don't condone teen marriage and I don't hold ANY men blameless for unwanted pregnancy.
Yet, just the subtle msg of "teen mothers" with "older men" citing distorted stat and being aware of the shift from today's society regarding teen pregnancy from condemnation to acceptance and support is an alarm bell ringing as to try to put the blame on men -not boys- as the rise of teen pregnancy under the old tiresome doctrine: poor seduced women, bad SOB men.

The blame, if any in particular, is in us, the adults... defending the new trend of discarding self accountability and "everything goes culture".

The 71% number belongs to the group of teen pregnancy cases of youngs mothers in the age bracket of 15-17 -with an average age gap of 3 yrs age difference- with steady boyfriend, fiance and/or living together arrageament with parents consent.
Which, incidentally, explains why the conviction rate from statutory rape remains in decline while teen pregnancy is on the rise.

This observation is not intented to undermine your integrity but, to show the obvious contradiction from denying what you recognize as a possibility in another context.
Trick or manipulation, if were inexistents... don't need to be mentioned.

This OP's case came was brought to court as the dream situation being waiting to happen for more than 30 yrs because has been the only one in which all circumstances presented as an example of trickery and/or manipulation were met. The claim was presented on the same grounds argued for consideration in the case Roe v Wade with the intention to recognize equal standing for men over their reproductive rights under the same grounds applied to women when sex for pleasure is not to be interpreted as sex for reproduction therefore, not implicit to motherhood.
Futhermore, it was argued the intention not to overturn previous precedent but, to offer options for way out rather than forced fatherhood on the same legal precept for women without preclusion or detriment of women's reproductive rights.

Don't say or imply it was intended to force women into motherhood or prohibit abortion. It's not truth.

The irony from the appeal ruling is that did recognized those circurmstances of trickery and/or manipulation yet, decided that the same principle to be applied to women doesn't have to be applied to men -separate but equal doctrine- as a legal recognition of double standard... which is not a surprise in application of Family Law.

Actually, there is a huge number of 'blondies' regarding this case.

As I understand, OP refers to what was known as Roe vs Wade for men -based on the 14th Amendment- and the Court decision in the appeal process ruled that the State has the power to treat people differently which implies the restoration of the abolished doctrine of "separate, but equal"... with the difference for its application being applied on gender instead of race.

Interesting observation to validate your position when the today's Court interpretations of fatherhood is beyond DNA pov to justify paternity fraud, loco parentis and double dipping.
Yet, I still have to read about a single case when a woman is forced to make child support payments for a child who doesn't belong to her or to assume motherhood when she doesn't want to, as the issue of this thread regarding men.

I offer you the concept, instead the list: gender feminism, as a distinction from equity feminism.
Once understood the difference, between preferential treatment based on gender to perpetuate antagonism and social equality based in a range of choices, standing and possibilities... everything fall into place and all wrongdoing is accepted as self-evident.

Incidentally, the main reason for the Third Wave to distance themselves from the old and tiresome diatribe of the remaining voices of the Second Wave.

Once the problem is identified become just a situation to be solved: the shift of cultural and moral influences replacing the ideology that insists on the differences than set us apart rather than the similarities that bring us together.

- Stop the gender war campaing viewing marriage as an institution of oppression.
- Stop the gender preferential treatment making from divorce, an industry.
- Stop the gender idea of conception of children as a personal choice instead a mutual one.
- Start to promote integration/collectivism instead selfishness/individualism to restore the importance of the nuclear family.

As long the law treats pedophiles like criminals instead mental unfits there is nothing that can be done. If there is no life prison sentence, they must be realeased since none can be on prison for crime they aren't committed.
I believe is not depending of the law but, from the criteria for influence of the medical community which is not consensual. If they were in a mental institution, they could be hold indefinitely.

Acording to my readings, the most three common reasons for divorce -not in this particular order- are lack of money, sex and communication.
As an interesting note, domestic violance among married couples amount only for the 6% as reason for separation.
Infidelity, from married and unmarried couples, runs around the same percentage (not significant difference) from both gender.
As an interesting note, while the males are holding the higher percentage # of cheaters , the females are easier to be discovered.

Those are readings done long time ago. I'd have to redo some research to back it up with the sources.

Naturalized Citizenship For Illegal Aliens

I agree that an amnesty plan is motivated by voters gain but, enabling illegals to become legals, through amnesty, it can be viewed for long term plan. Not a short one.
During the Presidential campaing both candidates: McCain and Obama stated to be pro-amnesty but, mostly, targeting the families of the illegals.
Last month, Obama ratified his intention to push a legislation granting partial/some amnesty but, unless a complete all new legislation for replacement of all present one -not just a Amnesty Bill or simple reform- those new legalized aliens won't be able to vote before the next election for at least six-seven yrs and considering a massive streamline process of legalization.

Regarding renouncing their current citizenship, is not requiered at the present from anyone. I see no reason of change for the future.

I wonder how familiar you're with immigration laws and the process for naturalization, beside the reasons to assume those requirements would be changed.
Just the title of thread "naturalization for illegal alien" is an absurd.

To begin with, an illegal alien granted amnesty, pardon, relief from removal and/or legalization by existing or new legislation to be implemented is not illegal anymore.
It's paroled by one or two years, depending reasons and/or country of origin, as conditional resident.
After granted with permanent residence, there is a requirement of five yrs period before to apply for the naturalization process to obtain citizenship.

And, in any case, during any time of criminal conviction related with blood, drugs, child abuse or felony battery/domestic violance occurs, among others, the permanent residence and/or the naturalization is revoked and trigger automatic immigration process for deportation which by 'de facto' implies that even as an American citizen by naturalization all alien to a point, are still visitors.

Being legally married, you are absolutely right in everything... as long you don't show intention of no return.
Basic law principle: criminal intent is the ground for criminal act and prosecution.
